13. Disclaimer of Warranties

CouplesNextDoor.com disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and availability. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

Nothing in these Terms creates any agency, partnership, joint venture, or fiduciary relationship between you and CouplesNextDoor.com.

14. Mandatory Arbitration & Class Action Waiver

Binding Arbitration

You and CouplesNextDoor.com agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of the Site shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction for claims related to intellectual property rights or unlawful content.

The arbitration shall take place in the State of Minnesota unless otherwise agreed by the parties. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver

YOU AND COUPLESNEXTDOOR.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

15. Limitation of Liability

To the fullest extent permitted by law, CouplesNextDoor.com shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Site.

In no event shall the total liability of CouplesNextDoor.com for any claim arising out of or relating to the Site or these Terms exceed the total fees paid by you to CouplesNextDoor.com during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
